European Commission clears Universal’s takeover of EMI


The European Commission has approved Universal Music Group’s takeover of EMI’s recorded music business under EU competition law.  The clearance comes after the Commission conducted an in-depth investigation into the competitive impact of the merger.  However, Universal has agreed to sell a significant number of labels, including Parlophone and EMI France, to address the major competition concerns identified by the Commission during its investigation.  The implementation of the remedies package will now be crucial to ensuring that the market remains competitive.


French Court upholds antitrust dawn raid on Amaury media group


The Court of Appeal in Paris has upheld a surprise investigation carried out by the French competition authority at the premises of the French media group, Amaury.  The dawn raid was part of the French competition authority’s investigation into allegations that Amaury, the publisher of L’Equipe, engaged in predatory market behaviour by launching a daily sports tabloid to destroy competition from a new competitor, 10-Sport.
